Terms and conditions
The use of the services contained in the GHB website implies the user’s express acceptance of the following general conditions:
GENERAL CONDITIONS OF TRADE
1. DEFINITIONS:
• CUSTOMER: Any individual or legal entity that seeks to make a hotel reservation.
• GHB: GREMI d’HOTELS DE BARCELONA S.L. (Single-Member Company) as provider of the information services.
• OFFER: List of services provided by each hotel establishment.
• HOTEL: Establishment where the CUSTOMER chooses to make the reservation.
• ORDER CONFIRMATION: Electronic document confirming the reservation.
• PRICE: Per-night rate in the selected hotel according to room use and services previously chosen by the CUSTOMER.
2. The following general conditions are applicable to all reservations made through this website. Any modification shall be made in writing by GHB. Acceptance of a reservation shall imply acceptance of these general conditions. GHB reserves the right to modify its general conditions at any time, without prejudice to any rights previously acquired.
3. For the purposes of choosing a hotel establishment, the CUSTOMER hereby acknowledges that the information and content provided by the HOTEL and that appearing on this website is sufficient.
4. Reservations shall be confirmed in writing by sending an e-mail to the address supplied by the CUSTOMER. This e-mail shall contain a confirmation, an identification code and the following details: name, address and telephone number of the hotel, check-in and check-out dates, type of rooms booked, type of board and total price of the services contracted. The CUSTOMER should check the order confirmation and provide immediate notification of any error therein. In the absence of any such notification, the confirmation shall be deemed correct and included as an integral part of the reservation agreement.
5. The reservation shall only be deemed effective when expressly accepted by GHB by means of a confirmation.
6. CREDIT CARDS.- Your credit card shall only be used to guarantee your reservation in the case of a no-show and in accordance with the clauses herein. The CUSTOMER must pay the hotel directly via the payment systems accepted by said establishment.
No charge shall be made to your credit card at the time of accepting the reservation.
7. GHB does not store your credit card details in any personal data file.
8. The CUSTOMER must arrive at the hotel before 6 pm on the check-in date. Should they fail to do so, the hotel may cancel their reservation.
9. RESERVATION CANCELLATION.
9.1). The customer has the right to cancel his/her reservation at no cost and with no cancellation charges up to forty-eight hours before the latest hotel arrival time (6.00 p.m.), except in the case of non-cancellable reservations (see Point 9.4). All cancellations must be made through this website.
9.2). If the reservation is made less than 48 hours before arrival or if the user does not show up, the cancellation charges will range from 25% to 100% of the total amount due, except in the case of non-cancellable reservations (see Point 9.4).
The hotel establishment may proceed to charge these penalties directly to the customer’s credit card, and the customer hereby expressly agrees not to challenge such charges.
9.3). If the reservation is made less than 24 hours before arrival or if the user does not show up, cancellation costs will range from 25% to 100% of the total amount due, except in the case of non-cancellable reservations (see Point 9.4).
The hotel establishment may proceed to charge these penalties directly to the customer’s credit card, and the customer hereby expressly agrees not to challenge such charges.
9.4). Non-cancellable reservations
Cancellation is not permitted on some reservations or dates, for example on special dates such as festivals, conferences, etc.
10. In accordance with the cooperative nature of GREMI d’HOTELS DE BARCELONA and the development of its objectives through GHB, and in accordance with the provisions of its articles of association, duly registered with the relevant administrative body, the CUSTOMER hereby acknowledges that:
• GHB acts solely and exclusively as an intermediary between the CUSTOMER and the HOTEL (member of the business organisation GREMI d’HOTELS DE BARCELONA).
• GHB has not prepared, modified or implemented the hotel information appearing on the website. Said information has been supplied by each hotel establishment.
• GHB does not have the power to monitor, control or execute the hotel accommodation agreement in the HOTEL chosen by the CUSTOMER.
Consequently, the CUSTOMER hereby accepts that GHB assumes no responsibility for the truthfulness, completeness or accuracy of the information on the various hotels, or for the compliance of said hotels with the reservation that may be made, or for the complete and proper provision of the hotel accommodation services.
11. The hotel agreement to which the reservation refers shall be carried out in accordance with the Ley de Turismo de Catalunya (Catalonia Tourism Law) and with other applicable administrative provisions which have not been expressly modified by the parties by means of these general conditions.
12. The CUSTOMER hereby agrees to abide by Spanish legislation and the jurisdiction of the courts and tribunals of Barcelona.
13. Any provisions regarding consumer rights, should the CUSTOMER fall under said condition, are expressly exempt.
14. By successfully requesting a reservation electronically through this website, the CUSTOMER accepts the terms, obligations and responsibility disclaimers laid down in these GENERAL CONDITIONS.
15. PRIVACY POLICY
We believe that privacy is extremely important. Collecting and transferring information about you is a routine part of our activity. In this privacy policy we describe the information that is collected by the File Manager at Gremi d’Hotels de Barcelona S.L., with headquarters in Barcelona (Spain), Via Layetana no. 47, and what may happen to this information.
When you register with our server, your personal details go into our database. This information is only used to process the services we offer.
The user declares that he/she is of legal age (over 18 years old) and has the necessary legal capacity to contract the services offered by the providers at GHB’s web site, also stating that they accept the binding nature of this agreement and that they understand and accept completely the conditions which are set out here on the use of this website and the services offered therein.
The personal information about you that we obtain and process comprises the data specified in each of the forms which you must complete in order to request the services or operations of the website.
Our main reason for collecting your personal information is to process and manage the respective hotel reservation together with the GHB members, thereby providing you with an easy and efficient service through our website.
In accordance with Section 22 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, GHB informs you that if you are interested in receiving publicity information on possible special and/or promotional offers from Barcelona hotel members of GHB, you should tick the relevant box.
16. CROSS-SALE OF INDIVIDUAL PACKAGES OR SERVICES (car rentals, ticket sales, etc.)
A large number of services are offered by external providers which help you to use our website (i.e. shared websites).
